Sponsor.The Contest is sponsored by My Home Renovator, Inc. (“Sponsor”), 201 Government Ave. SW. Suite 208, Hickory, NC 28602.
Eligibility.The Contest is open to legal residents of the United States who: (a) are 18 years or older at the time of entry; (b) own a residential home within Illinois, Iowa, Minnesota, North Carolina, or Wisconsin (a “Participant State”) at the time of entry; and (c) complied with the Entry Procedures during the Qualification Period.The Contest is void everywhere other than the Participant States and otherwise where prohibited or restricted by law. Sponsor’s employees, contractors, licensees, franchisees, advertising and promotional agencies, and the immediate family members of each are not eligible.
Qualification Period.The period during which entrants may qualify for the prize drawings begins at 12:01 a.m. (EST) on October 1, 2022 and ends at 11:59 p.m. (EST) on December 31, 2022 (“Qualification Period”).
Entry Procedures. To enter the Contest you must complete an on-line entry form through a Sponsor representative at a Walmart Store where Sponsor has a presence or via a scanned QR code that is available at any Walmart Store where Sponsor has a presence. The entry form must include all requested information, including the entrant’s residential address, home or mobile phone number, and e-mail address, identity of Walmart Store where form completed or QR code scanned and, if applicable, product of interest. Mechanically reproduced or photographed entries will not be accepted. Entries are limited to one per household per Qualifying Period. Any attempt to enter more than once per household per Qualifying Period will result in all entries by such person or household during the Qualification Period void. Entries become Sponsor’s property.
Description of Prize. The winner will receive a $10,000 credit (“Prize”) that may be used toward a home improvement project (“Project”) of the winner’s choosing, subject to Prize Limitations.
Selection of Winners; Chances of Winning.Prizes will be awarded in a random drawing held from among eligible entries within 10 days after the end of the Qualification Period. Odds of winning depend on the total number of entries received.
Prize Limitations.The Project must be performed by a single home renovator that is within Sponsor’s contracted network of home renovation contractors and that serves its customers within the zip code of the winner’s residential address (“Dealer”). The winner must own a residential home (not necessarily the same home as at the time of entry) in a Participant State, at which a Dealer may perform the Project when claiming the Prize. The products or services that are available to the winner and subject of the Prize depends on the type and scope of products and services the Dealer offers within the winner’s zip code at the time the winner claims the Prize. Sponsor makes no representations or warranties as to the Project or the type or scope of products or services that might be available. The winner and Dealer are solely responsible for negotiating and entering terms under which Dealer may perform the Project, including the Project’s overall cost and any warranties.The Project must be commenced within one calendar year from the date Sponsor notifies winner that he/she has won. Sponsor retains full discretion as to when during the Project to apply the credit and may apply the credit in increments, so long as the sum of credits equals the Prize value.If anyone other than the winner has an ownership interest in the home for which the Prize is claimed, Dealer may require such other person(s) to agree to any the terms under which the Project may be performed. If the Project does not conform to the winner’s expectations, contract, or applicable law, the winner’s sole recourse shall be against Dealer or otherwise as permitted by applicable law and, in no event, shall winner have any recourse against Sponsor. If the Project’s cost exceeds the Prize value, the winner shall be solely responsible for the excess cost. If the Project’s cost is less than the Prize value, the Prize value shall, nonetheless, be exhausted and the winner shall not retain any credit or other right to further products, services, or other value.
Notification of Winners; Substitution of Prizes.Winners will be notified by telephone, text, or e-mail. Sponsor will attempt to contact the winner up to three times. If a winner does not respond within three days of a third attempted contact, the Prize is forfeited, and an alternate winner will be randomly selected. Winners may not substitute, assign, or transfer prizes. Sponsor reserves the right to substitute a prize of equal or greater value in the event a prize is unavailable. Prizes are not redeemable for cash. Limit: one prize per household.
Permissions. Except where prohibited by law, entry constitutes Sponsor’s permission, without further approval or compensation, to: (a) use winners’ names, hometowns, and likenesses for online posting, and/or any advertising and publicity; and (b) store and use personal information, including entrant’s name, phone number, address, e-mail address and products/services of interest, provided by entrant for purposes of Sponsor marketing, soliciting, and selling products or services to entrant. Winners may be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a prize. Failure to comply with these conditions shall be grounds for forfeiture of a prize.
Duties of Entrants; Limitation of Liability. By entering, entrants agree to be bound by these rules and Sponsor’s decisions, which shall be final. All federal, state, and local laws apply. All taxes on a Prize are winners’ responsibility. Sponsor and its employees, officers, directors, shareholders, agents, representatives, affiliates, subsidiaries, and advertising, promotion, marketing, and legal advisors are not responsible for and shall not be liable for: (a) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (b) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (c) errors in transmission; (d) any condition caused by events beyond Sponsor’s reasonable control that may cause the contest to be disrupted or corrupted; (e) any injuries, losses, or damages to person or property of any kind caused by a prize or resulting from acceptance, delivery, installation, possession, or use of a prize, or from participation in the Contest; or (f) any printing or typographical errors in any materials associated with the Contest.Winner may be required to show proof of identity and ownership of the home at which the Project is to be performed. If, for any reason, the Contest cannot be run as planned, including infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond Sponsor’s reasonable control that, in Sponsor’s discretion, corrupts or affects the Contest’s administration, security, fairness, integrity, or proper conduct, Sponsor may, in its sole discretion, cancel the Contest and select a winner from eligible entries received before cancellation. By entering the Promotion, each entrant represents and warrants that he or she has read these Official Rules and is fully familiar with its contents.
Resolution.The Contest, the Official Rules, and all questions and disputes relating to them, shall be exclusively governed by and construed under Ohio law, without regard to any choice of law or conflict of law rules. Legal proceedings arising out of or relating in any way to the Contest or the Official Rules shall be instituted in a federal or state court located in Cuyahoga County, Ohio. Each entrant submits to exclusive personal jurisdiction in such courts, waiving any right to trial by jury, and agrees not to commence, maintain, or participate in a legal proceeding arising out of or relating in any way to the Contest or the Official Rules in any other forum. Each entrant agrees that: (a) to the fullest extent permitted by applicable law, all disputes, claims and causes of action arising out of, or relating to the Contest or a prize shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Cuyahoga County, Ohio; (b) claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred (including costs associated with entering the Contest and accepting the Project but expressly not including attorney’s fees or costs); (c) entrant irrevocably waives any right to seek injunctive or equitable relief; and (d) under no circumstances will an entrant be permitted to obtain any award for, and each entrant waives all rights to claim, punitive, special, incidental or consequential damages and all rights to have damages multiplied or otherwise increased and any other damages other than for actual out-of-pocket expenses.
Violation of Contest Rules.Sponsor reserves the right to disqualify an entrant or winner who, in Sponsor’s sole discretion, tampers with the entry process or violates the Official Rules or any other terms relating to the Contest, acts in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass another person. If there is a discrepancy between (a) a statement made by a Dealer or a Sponsor representative or contained in promotion materials and (b) these Official Rules, these Official Rules shall control. Sponsor’s not enforcing a term of these Official Rules shall not constitute a waiver of that or any other term.
